A medical question can be referred to Medical Panels, when there is an aspect of the medical condition that needs to be clarified during the assessment, or management of a Workers Compensation claim, or a Wrongs Act claim.

A medical question can be referred by: 

  • authorised WorkSafe Agents;
  • Accident Compensation Conciliation Services (ACCS);
  • Magistrates' and County Courts;
  • VCAT; and
  • self-insured employers.

In a Wrongs Act claim, impairment threshold determinations can be referred by a party acting for a Respondent.

A Medical Panel provides the final opinion in relation to the medical question that was asked. This Opinion is binding on any court, body or person.
